1. Scope
All orders placed by customers and business owners through our online shop are subject to the terms and restrictions listed below.
Any natural person who engages in a legal transaction for motives that are primarily neither commercial nor self-employed is referred to as a consumer. An entrepreneur is a natural or legal person, or a partnership with a legal capacity, who engages in commercial or autonomous professional activity while entering into a legal transaction.
Entrepreneurs must adhere to the following: Any additional or contradictory general terms and conditions are hereby declared invalid and only become a part of the contract with our express written consent.
2. Contractual party, completion of the agreement
A purchase agreement has been reached with Multifacet UG.
By listing the goods in the online store, we formally propose to enter into a contract with you for them. By utilizing the correction tools offered and described during the purchase process, you can first add our items to the shopping cart without incurring any obligations and change your entries at any moment before placing your binding order. When you click the order button after accepting the offer for the items in your shopping basket, the contract is complete. You will get another email confirmation as soon as the order is sent.
3. Contract terminology and text storage
German And English is the language that can be used to finalize the deal.
We send you the order information, our terms and conditions, and the content of the contract as a text file. The language of the contract is no longer available on the Internet due to security concerns.
4. Delivery Conditions
The prices of the products are indicated plus shipping charges. The offers provide further information regarding the delivery charges.
We just mail out packages. Unfortunately, a product's self-collection is only possible when it is specifically mentioned.
Payment 5.
In our store, the following payment options are typically accepted:
Bank transfer
Normal wiretransfer to the company bank account mentioned on the invoice.
PayPal
You will be sent to the website of online retailer PayPal throughout the ordering procedure. You must be logged into PayPal or register first, authenticate yourself using your access info, and confirm the payment order with us before you may pay the invoice amount using PayPal. We ask PayPal to start the payment process after placing the order in the store. Immediately after, PayPal automatically completes the payment transaction. More details will be sent to you upon placing your order.
6. Withdrawal Rights
According to the cancellation policy, you are qualified for the statutory cancellation rights.
7. Title retention
Up to complete payment, the things are still our property.
The following also holds true for business owners: Until all claims arising from a continuing business relationship have been fully resolved, we reserve title to the items. The reserved goods may be resold by you in the regular course of business; nevertheless, regardless of whether the reserved goods are merged or mixed with a new item, you hereby assign to us any claims arising from such resale in an amount equal to the invoice amount, and we thus accept such assignment. You are still allowed to collect the claims, but if you don't fulfill your payment duties, we may also go ahead and do it for you.
8. Transit-related harm
Consumers should report any mistakes to the deliverer as soon as possible and should call us right away if they receive items with visible transit damage. Your legal claims and their enforcement, including your warranty rights, are unaffected by the lack of a complaint or communication. They do, however, make it easier for us to make our own claims against the carrier or the transport insurance.
The following is true of business owners: As soon as we send the item to the freight forwarder, the carrier, or the person or organization otherwise in charge of carrying out the shipping, the risk of unintentional loss and degradation transfers to you. Merchants are subject to the Section 377 of the German Commercial Code's (HGB) requirements for examination and fault notification. Unless there is a flaw that was not apparent during the inspection, the items are considered to have been accepted if you fail to provide the notification required there. If we hid a flaw deceptively, then this does not apply.
9. Guarantees and Warranties
The statutory right to responsibility for deficiencies shall apply unless specifically provided otherwise below.
When customers buy used products, the following rule applies: claims for defects are not valid if the fault manifests more than a year after the items were delivered. Within the two-year statutory limitation period following delivery of the products, defects that manifest within a year of delivery of the items may be brought to light.
Entrepreneurs have a year from the date of risk transfer to file claims for flaws in newly manufactured goods. Used products are sold "as is," with no warranties provided. The statutory time limits for exercising a right of recourse under 445a BGB are unchanged.
Entrepreneurs are only bound by our own knowledge and the manufacturer's product specifications that were included in the contract as a guarantee of the quality of the items; we disclaim any responsibility for the manufacturer's public comments or other promotional claims.
Entrepreneurs are initially covered by a warranty if the supplied item has a flaw, which we may fix (repair) or replace (replacement delivery) at our option.
Any claims based on harm we, our legal representatives, or vicarious agents have caused are exempt from the limits and deadline reduction described above.
10. Responsibilty
If we, our legal representatives, or our vicarious agents are slightly negligent and violate one of the essential contractual obligations that are necessary for the contract's proper execution and that the contractual partner may regularly rely on (cardinal obligations), our liability is only limited to the amount that was reasonably foreseeable at the time the contract was made. Damage limitation, whose occurrence must normally be anticipated.
Damages claims are not allowed in the other cases.
11. Dispute Settlement
You can discover a platform for online dispute resolution (OS) provided by the European Commission here. We are not required nor eager to take part in a consumer arbitration board's dispute resolution process.
12. Last Minute Rules
The UN Sales Convention is not applicable if you are a business owner since German legislation does.
Our place of business shall be the only and exclusive venue for any disputes originating from any contractual agreements between us and you if you are a merchant within the meaning of the Commercial Code, a legal entity under public law, or a special fund under public law.
